"The Constitutional Court,
-Having regard to the Constitution, in particular its articles 56, 85, 87, 88, 89, 91 (paragraphs 10 and 11) and 191,
-Having regard to Ordinance 21-01 of 26 Rajab 1442 corresponding to March 10, 2021, relating to the organic law relating to the electoral system, amended and supplemented, in particular its articles 245, 246, 247, 256, 258 and 259 (paragraphs 4 and 5), 260, 272 (paragraph 2) and 275 (paragraph 6),
-Having regard to the Regulation of 9 Safar 1444 corresponding to 5 September 2022 establishing the operating rules of the Constitutional Court, in particular its articles 57, 61, 62, 88, 89, 90 and 91,
-Having regard to Presidential Decree 24-282 of 2 Dhou El Hidja 1445 corresponding to 8 June 2024 convening the electoral body for the organisation of an early presidential election,
-Having regard to the decision 06/DCC/24 of the Constitutional Court of 25 Moharram 1446 corresponding to 31 July 2024 validating the final list of candidates for the early presidential election,
- Having taken note of the provisional results of the presidential election announced by the National Independent Election Authority on 4 Rabie El Aouel 1446 corresponding to 8 September 2024,
- After having taken note of the minutes of the vote counting, the minutes of the communal census, the minutes of the centralization of the results established by the wilaya electoral commissions and by the electoral commission of residents abroad,
- After examining the two appeals filed with the registry of the Constitutional Court by the candidates:
* Hassani Cherif Abdelaali for the Movement of Society for Peace (MSP)
* Aouchiche Youcef for the Socialist Forces Front (FFS),
Which appeals were accepted in form and substance.
- By virtue of decision number 7 of the Constitutional Court of 8 Rabie El Aouel 1446 corresponding to September 12, 2024 concerning the appeal against the provisional results introduced by the representative of the candidate Hassani Cherif Abdelaali for the Movement of the Society for Peace.
- Pursuant to decision number 8 of the Constitutional Court of 8 Rabie EL Aouel 1446 corresponding to September 12, 2024 concerning the appeal against the provisional results introduced by the representative of the candidate Aouchiche Youcef for the Socialist Forces Front.
- After listening to the reporting members,
- After examining the various electoral documents, including invalid ballots and proxies,
- And after the correction of material errors and the establishment of the final results of the vote,
The Constitutional Court reached the following final results:
- Total number of registered voters inside the country and abroad: 24,351,551
- Total number of voters: 11,226,065
- Overall participation rate: 46.10%
- Invalid ballots: 1,764,637
- Votes cast: 9,461,428
- Absolute majority: 4,730,715
Votes obtained by each candidate in descending order:
- Mr. Tebboune Abdelmadjid received 7,976,291 votes, or 84.30%
- Mr. Hassani Cherif Abdelaali received 904,642 votes, or 9.56%
- Mr. Aouchiche Youcef received 580,495 votes, or 6.14%
-Considering that under Article 85 (paragraph 2) of the Constitution, the election is acquired by an absolute majority of the votes cast by the electors,
- and considering that the candidate Tebboune Abdelmadjid obtained the absolute majority of the votes cast by the electors,
The Constitutional Court announces the following:
- Mr. Tebboune Abdelmadjid is proclaimed president of the Algerian Democratic and Popular Republic for a second term.
- He takes office immediately after taking the oath, in accordance with Article 89 of the Constitution.
- This proclamation is published in the Official Journal of the Algerian Democratic and Popular Republic.
